PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

(California Consumer Privacy Act / California Privacy Rights Act)

This California Privacy Notice supplements the information provided in our general Privacy Policy and applies solely to visitors, users, and customers who reside in the State of California (“consumers,” “your,” or “you”). “We,” “us,” “our,” and “Diamond Art Club” refers to Diamond Art Club, LLC.

We adopt this notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”), and all terms used in this notice have the same meaning as defined in the CCPA and its implementing regulations.

1. Information We Collect

The diamondartclub.com website (the “Site”) and related services collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“Personal Information”).

Personal Information does not include: publicly available information from government records; deidentified or aggregated consumer information; or information excluded from the CCPA’s scope (such as health information covered by HIPAA/CMIA, or information covered by the GLBA, FCRA, or DPPA).

2. Use of Personal Information

We may use or disclose the Personal Information we collect for one or more of the following business or commercial purposes:

  • To fulfill or meet the reason you provided the information (e.g., processing orders, shipping products).
  • To provide, support, personalize, and develop our Site, products, and services.
  • To create, protect, maintain, and customize your account.
  • To process your requests, purchases, and transactions, and to prevent transactional fraud.
  • To provide you with customer support and to respond to your inquiries.
  • To personalize your Site experience and deliver relevant content, product offerings, and advertising.
  • For research, testing, analysis, and product development, including improving our Site and services.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you at the time of collection or as otherwise set forth in the CCPA.

3. Sharing and Disclosure of Personal Information

We may disclose your Personal Information to a third party for a business purpose. When we do, we enter into a contract that describes the purpose of the disclosure and requires the recipient to keep that Personal Information confidential and not use it for any purpose except performing the contract.

We may disclose your Personal Information to the following categories of third parties:

  • Subsidiaries and affiliates.
  • Contractors and service providers (e.g., payment processors, shipping providers, email service providers, analytics providers).
  • Third parties with whom we partner to offer products, promotions, or services to you.
  • Our equity investors and their advisors, subject to confidentiality agreements, for legitimate business purposes such as corporate governance and reporting.

4. Sale and Sharing of Personal Information

We do not “sell” Personal Information as that term is defined under the CCPA. We do not have actual knowledge that we sell the Personal Information of consumers under 16 years of age.

We may “share” (as defined by the CCPA) certain Personal Information—such as online identifiers and Internet activity information—with advertising technology partners for purposes of cross-context behavioral advertising. You have the right to opt out of this sharing, as described below.

5. Sensitive Personal Information

We collect certain categories of information classified as “Sensitive Personal Information” under the CCPA, including account login credentials and payment card information. We use Sensitive Personal Information only for purposes authorized by the CCPA, including: (a) performing services or providing goods you request; (b) ensuring security and integrity; (c) detecting and preventing fraud; and (d) verifying or maintaining the quality of our services. We do not use or disclose Sensitive Personal Information for purposes of inferring characteristics about you.

6. Data Retention

We retain each category of Personal Information for as long as reasonably necessary to fulfill the purposes for which it was collected, as described in this notice. Specific retention periods are determined based on:

  • The nature of the Personal Information and the purposes for processing.
  • The length of time needed to provide our products and services to you.
  • Applicable legal, regulatory, tax, accounting, or reporting requirements.
  • Whether there is a legal basis to continue processing (e.g., statute of limitations for potential claims).

When Personal Information is no longer necessary for any of the above purposes, we will securely delete or de-identify it.

7. Your Rights and Choices

The CCPA provides California residents with the following rights. To exercise any of these rights, please see Section 8 below.

Right to Know / Access

You have the right to request that we disclose the categories and specific pieces of Personal Information we have collected about you, the sources of collection, the business or commercial purpose for collecting or sharing, and the categories of third parties to whom we have disclosed your Personal Information.

Right to Delete

You have the right to request that we delete your Personal Information, subject to certain exceptions (such as completing a transaction, detecting security incidents, exercising free speech, or complying with a legal obligation).

Right to Correct

You have the right to request that we correct inaccurate Personal Information that we maintain about you, taking into account the nature of the Personal Information and the purposes of processing.

Right to Opt Out of Sale/Sharing

You have the right to direct us to not sell or share your Personal Information. While we do not sell Personal Information, if you wish to opt out of any sharing for cross-context behavioral advertising, you may do so by contacting us using the methods in Section 8.

Right to Limit Use of Sensitive Personal Information

You have the right to limit the use and disclosure of your Sensitive Personal Information to uses that are necessary to perform the services or provide the goods you request, or as otherwise authorized by the CCPA. We do not use Sensitive Personal Information beyond these authorized purposes.

Right to Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not deny you goods, charge you different prices, provide a different level of quality, or suggest that you may receive a different price or level of quality.

8. Exercising Your Rights

Only you, or a person registered with the California Secretary of State that you have authorized to act on your behalf (an “authorized agent”), may make a verifiable consumer request related to your Personal Information.

You may make a verifiable consumer request for access or data portability up to two (2) times within a 12-month period. The request must provide sufficient information to allow us to reasonably verify your identity and describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to it.

9. Response Timing and Format

We will confirm receipt of your request within ten (10) business days and will respond to a verifiable consumer request within forty-five (45) calendar days of its receipt. If we require more time (up to an additional 45 days, for a total of 90 days), we will inform you of the reason and extension period in writing. We do not charge a fee to process your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine a fee is warranted, we will tell you why and provide a cost estimate before completing your request.

10. Right to Appeal

If we deny your request in whole or in part, you have the right to appeal our decision by contacting us at [email protected] with the subject line “CCPA Appeal.” We will respond to your appeal within the timeframe required by law. If your appeal is denied, you may file a complaint with the California Privacy Protection Agency at cppa.ca.gov.

11. Changes to This Notice

We reserve the right to amend this privacy notice at our discretion and at any time. When we make material changes, we will post the updated notice on our website and update the “Last Updated” date above.
